Disclosure pursuant to Art. 13 GDPR (EU Regulation 2016/679)

on the processing of personal data within the framework of the real estate lease contract for tourist use with BAGLIO CELLA di Melioli Luisa & C. s.a.s.

1. Principles

The protection of personal data of the tenants, as data subjects, is important to us and, therefore, we inform that Baglio Cella di Melioli Luisa & C. s.a.s. (hereinafter “Baglio Cella“) which Holder will provide the treatment in compliance with principles of fairness, lawfulness, transparency and protection of confidentiality.

2. Data subject to processing

Identifying, personal, tax, telephone, e-mail, home or business address, banking or financial data.

Failure to provide the data will not allow to finalize the signing and subsequent execution of the real estate lease contract for tourist use with Baglio Cella.

3. Purpose and legal basis for processing

(a) Purposes related to the signing and execution of the real estate lease agreement for tourist use with Baglio Cella and related and instrumental to the same such as communications with tenants, administrative and accounting management of the reservation, assistance during the tourist stay, communications and periodic updates related to the tourist lease and anything else required by the Regulations; the processing of data is necessary to fulfill contractual, statutory, regulatory obligations imposed by the Authority under Art. 6 (1) (b) GDPR.

(b) Marketing purposes; data processing is carried out after obtaining consent in accordance with Art. 6 (1) (a) GDPR; consent is optional and does not affect the signing and subsequent execution of the real estate lease agreement for tourist use with Baglio Cella; marketing purposes may concern:

b.1. promotions regarding various tourist rental formulas or other ancillary services, also depending on the season and type of accommodation;

b.2. promotions regarding various types of tourist rentals or other ancillary services, also depending on the season and type of accommodation.

(c) Profiling purposes; data processing is done after obtaining consent in accordance with Art. 6 (1) (a) GDPR – consent is optional and does not affect the signing and subsequent execution of the real estate lease agreement for tourist use with Baglio Cella.

(d) Safeguard purposes of Baglio Cella; the processing of the data is done for Baglio Cella’s legitimate interest pursuant to Art. 6 (1) (f), provided that the interests or fundamental rights and freedoms of the data subject do not prevail.

4. Withdrawal of consent

The consent to marketing and/or profiling given at the time of booking or signing the real estate lease contract for tourist use with Baglio Cella, can be revoked at any time, without prejudice to the lawfulness of the processing carried out before the revocation and without prejudice to the continuation of the tourist lease.

5. Recipients of the data

Data may be processed by employees or collaborators of the Data Controller appointed as data processors or by companies performing outsourcing activities, including website management or cloud computing services, external suppliers, professionals or consultants.

Personal data will not be disseminated.

6. Data transfer abroad

Data will be processed within the EU and in particular Italy. In case of changes and/or if a transfer to other non-EU countries becomes necessary, reference will be made to countries for which an adequacy decision exists and prior notice will be given.

7. Retention period

The data collected will be retained for as long as necessary to fulfill the specific processing purposes described in Article 3 above, unless shorter or longer retention periods apply pursuant to law.

With specific regard to marketing and/or profiling purposes, the data collected will be kept for a period not exceeding 24 (twenty-four) and 12 (twelve) months from registration, respectively.

In case of cancellation or termination of the tourist lease reservation, personal data will be retained for administrative purposes only, and will cease to be processed for any other formalities, for a period of three months, subject to legal requirements for the preservation of accounting records.

8. Data controller

9. Rights of the data subject

With reference to the personal data provided, the data subject may exercise the following rights:

– the right to request from the Data Controller access to and portability of personal data and the rectification or erasure of personal data or the restriction of the processing of personal data concerning him or her or to object to its processing;

– The right to revoke consent at any time without affecting the lawfulness of the processing carried out before revocation ;

– The right to file a complaint with a supervisory authority ;

– Right to become aware, by the Controller and without justified delay, of a personal data breach likely to present a high risk to the rights and freedoms of natural persons (Art. 34 GDPR).

If you feel that you have been injured in any of your rights, you can file a complaint with the Garante per la protezione dei dati personali (following the procedures and directions published on the Authority’s website at www.garanteprivacy.it) or an administrative or judicial appeal.
